PRIVACY POLICIES AND PROCESSING OF PERSONAL INFORMATION
1. Scope of Application
This policy (Hereinafter, the “Policy”) applies to the collection, registration, conservation, use, processing, storage and transfer (Hereinafter, the “Processing” and/or “Process”) carried out by Santiago Queirolo S.A.C., identified with Unique Taxpayer Number (R.U.C.) No. 20100097746, with address at Av. San Martin 1062, district of Pueblo Libre, province and department of Lima (Hereinafter, “Santiago Queirolo”), a company dedicated to the production and sale of alcoholic beverages, about the personal information of the users of this website (Hereinafter, the “Website”). The processing of personal information and this Policy are developed in compliance with the provisions of Law No. 29733, Personal Information Protection Law, and its Regulations, Supreme Decree No. 003-2013-JUS (Hereinafter, the “Personal Information Protection Regulations”).
The purpose of this Policy is to make public knowledge our commitment to the protection of personal information, as well as the guidelines under which Santiago Queirolo processes them in the exercise of its commercial activities, the purpose for which it is carried out, as well as such as the procedures so that their owners can exercise the rights of access, rectification, cancellation and opposition provided for in the Personal Information Protection Regulations.
2. Personal Information Regarding to Processing and Personal Information Bank
The personal information provided to Santiago Queirolo will be those delivered through the electronic form, upon registration of the owner of personal information to obtain information related to the offered products and services; and, for the management of reservations for tours in the vineyards owned by Santiago Queirolo, the same as detailed below: Full name, identification document, email and telephone or cell phone (Hereinafter, the “Personal Information”).
The user’s Personal Information will be registered in the personal information bank owned by Santiago Queirolo called “Clients” and located at the address indicated in point 1 above, which will be processed only for the period required to carry out the necessary purposes described, as appropriate.
3. Purposes, Conditions and Term of Processing of Personal Information
Santiago Queirolo will process the Personal Information for the following necessary purposes, which are exempt from obtaining user consent in accordance with Article 14 of the Law:
Absolution of queries made by users of the Website.
Quote of Santiago Queirolo products (Such as Piscos and wines) for sale.
Management of tour reservations to Queirolo Vineyard, changes and/or cancellations thereof.
Sending quotes for reservations
Legal obligations applicable to Santiago Queirolo by virtue of access to the website and the services provided to users.
If Santiago Queirolo requires the use of the user’s Personal Information for purposes additional to those detailed above, it must have the user’s prior, express, informed, and unequivocal consent for such purposes. Santiago Queirolo may, with the consent of the users, use their Personal Information to carry out statistical analysis about the use of the Website, send advertising, send surveys and promotions, improve the characteristics and contents of the Website, including the improvement of the services accessed by the user on the Website, among others.
The user declares that all the requested Personal Information are considered necessary by Santiago Queirolo, so if these are not provided, it could prevent adequate attention from Santiago Queirolo for the processing purposes indicated above.
4. Security and Confidentiality
In this regard, Santiago Queirolo will process the Personal Information in accordance with the Personal Information Protection Regulations, having adopted the levels and technical security measures designed to prevent the loss, misuse, alteration, unauthorized access, destruction, or theft of the Personal Information. For this purpose, only authorized employees have access to the information that the owner of personal information grants, which is limited to the function they perform.
5. Transfer of Personal Information and Cross-border Flow:
Santiago Queirolo informs that he may: (a) Transfer personal information to legally empowered public entities within the scope of their powers, either upon their request, or in compliance with current or future regulations; or to private entities allied and/or related to Santiago Queirolo that are necessary for the fulfillment of the purposes described in this Policy, such as Internet access systems, with advertisers, associates, sponsors, cloud providers, software development and design or other solutions, among other services that were necessary for the website; and, (b) entrust the processing of personal information to private companies that are allied or that are part of our same business group, also for the fulfillment of the purposes described in this Policy, and that these must comply with the security, organizational, and confidentiality measures applicable according to the Personal Information Protection Regulations.

If users require updated information about those in charge of processing and/or the transfers of personal information made to third parties by Santiago Queirolo, they may request said information through the email detailed in section 6 below, and Santiago Queirolo must send said information within a period of no more than five (5) calendar days so that the user has access to this information and could exercise their ARCO rights.
6. ARCO Rights and Contact Information
The ARCO rights (Access, Rectification, Cancellation and Opposition) that the owners of personal information have, in accordance with the Law and Regulations, are the following:
Access: Right of the user to obtain the information that Santiago Queirolo has in the Information Bank about said user.
Rectification: Right to modify information that turns out to be partially or totally inaccurate, incomplete, erroneous, outdated, or false.
Cancellation: Right to request the deletion or cancellation of your Personal Information from the Santiago Queirolo Information Bank when they are no longer necessary or relevant for the purpose for which they were collected, or in cases in which they are not being treated in accordance with the Personal Information Protection Regulations.
Opposition: Right to object, for a legitimate and well-founded reason, referring to a specific personal situation, to appearing in an Information Bank or to the processing of your Personal Information, provided that the law does not provide otherwise.
The owner of the Personal Information is informed that to exercise their rights of access, rectification, cancellation, and opposition, provided for in the Personal Information Protection Regulations, the owner of Personal Information may submit their request through the email mkt.vinasqueirolo@gmail.com or any other channel that the company informs in the future. The response to said request will be made within the period established by the Personal Information Protection Regulations.
7. Principles that Guide the Processing of Personal Information
The principles that guide the processing of personal information and that Santiago Queirolo undertakes to respect and comply with are the following:
Principle of Legality: The processing of Personal Information is carried out in accordance with the provisions of the Personal Information Protection Regulations, and the collection of personal information by fraudulent, unfair, or illicit means is prohibited.
Principle of Purpose: Personal Information must be collected for a specific, explicit, and lawful purpose, and its processing must not extend to any purpose other than that for which it was collected.
Principle of Consent: For the processing of Personal Information, the User’s consent must be obtained, except in cases excepted by the Personal Information Protection Regulations.
Principle of Proportionality: The processing of Personal Information must be appropriate, relevant, and not excessive to the purpose for which it was collected.
Principle of Quality: The Personal Information to be processed must be true, accurate and, to the extent possible, updated, necessary, relevant, and appropriate with respect to the purpose for which it was collected.
Principle of Provision of Recourse: The owner of the Personal Information must have the necessary administrative or jurisdictional means to claim and enforce their rights when these are violated by the processing of their Personal Information.
Principle of Security: The owner of the Personal Information bank and the person in charge of its processing must adopt the necessary technical, organizational, and legal measures to guarantee the security of Personal Information.
Principle of Adequate Level of Protection: For a sufficient level of protection for the Personal Information to be processed or, at least, comparable to that provided by the Law or international standards on the matter.
8. Update of this Policy This Processing Policy has been updated as of October 17, 2023, and may be modified by Santiago Queirolo when it deems appropriate. If any change or modification of this Policy occurs, the current text thereof will be published on our Website.
